The Court DENIES Defendant's Petition for Writ of Habeas Corpus (Post-Conviction) because Petitioner failed to raise the issue of the constitutionality of Senate Bill 182 on appeal. This use should have been raised on direct appeal. Petitioner filed a direct appeal on April 3, 2012. The Nevada Supreme Court issued its remittitur on December 6, 2015. Thus, Petitioner's claim is waived for failure to raise the issue on direct appeal. State to prepare the proposed order. Court noted there was no authority to have a closed door hearing as requested by Mr. Anderson. Mr. Anderson argued regarding the Motion to Consolidate and expressed safety concerns. Court stated it was not going to close the proceeding and reviewed the history of the case. Argument by Mr. Anderson and Mr. Niman regarding the Motion. Court reviewed applicable case law and prior court decisions. Court inquired when Mr. Anderson first raised the issue of unconstitutionality on appeal; reviewed the Court's decision in 2013 on the first appeal filed by Mr. Anderson. Mr. Anderson argued regarding computation of time. Court advised computation of time was not an issue before this Court and would further consider the issue of constitutionality. COURT ORDERED, matter TAKEN UNDER ADVISEMENT.

Defendant's Notice Of Motion/Response to the Dept. 10 matter FILED IN OPEN COURT. Court reviewed the history of the case. Discussions regarding there being two (2) types of Habeas petitions an inmate can file; one that challenges the underlying conviction/underlying judgment and one that challenges the way the Nevada Department of Corrections applies Deft's sentence and keeps record of the days in which Deft. is incarcerated. Counsel stated both can not be challenged in one petition. COURT NOTED, time computation challenges are heard in Dept. 10, therefore ORDERED, the time computation part of Deft's petition is DISMISSED WITHOUT PREJUDICE and matter will be heard in Dept. 10. COURT FURTHER NOTED, Deft's challenge to the constitutionality of Senate Bill 182 as it might affect Deft's conviction would be heard before this Court. Court summarized the case history that Petitioner Anthony Anderson filed a Post-Conviction Petition of Writ of Habeas Corpus on March 13,2017. Court previously found no service of the Petition on the State of Nevada nor the Attorney General. The Court therefore set a Status Check for June 8,2017 to determine whether the Petitioner has corrected the deficiency of service. The Petitioner served the Office of the Attorney General on March 17,2017. At the Status Check on June 8,2017, neither the Petitioner nor anybody else appeared. Court Ordered that the Petition was dismissed with prejudice. The Petitioner appealed the decision to the Supreme Court and the matter was remanded January 29, 2018. The Court then vacated it's the prior dismissal of the Petition, and sets a further Status Check for this matter on Tuesday, February 6,2018. Court noted that the Anthony Anderson was incarcerated in NDOC and was being transported to the February 6, 2018 hearing. The Defendant unfortunately was not transported in a timely manner and was not present at the hearing. Court advised that the Petitioner was not appointed counsel for a post conviction relief. COURT ORDERED, matter CONTINUED for further status check March 14, 2018, 9:00am. Petitioner to be transported by NDOC. Gary Walters an independent research analyst, present, submitted a document for the Court to review before the next status check.
