ALL PENDING MOTIONS 2/28/05 Relief Clerk: Jennifer Lott Heard By: Kathy Hardcastle PLTF'S Motion for Temporary Restraining Order/Motion for Protective Order ....DEFT'S OPPOSITION TO PLTF'S APPLICATION FOR TRO/PRELIMINARY INJUNCTION/ COUNTERMOTION TO DISMISS Mr. Tomlinson requested a copy of all financial records and backup documentation concerning the partnership as the documents provided were incomplete. Further, Mr. Tomlinson requested Court order defendant to follow the partnership agreement and continue in a business-like and profitable manner. Statement by Mr. Tomlinson regarding $350,000 over-payment to Mr. Chung; argument by counsel in support of his motion. Argument by Mr. Lee in opposition to motion; counsel stated Court should not take jurisdiction as parties agreed to arbitration if a dispute arose. Following arguments by counsel, COURT ORDERED, Court CANNOT ORDER defendant to run the partnership pursuant to the partnership agreement; therefore, that portion of motion is DENIED; motion is GRANTED IN PART regarding copies, and someone MAY INSPECT the documents with copies MADE at 25 cents a copy.
