Overview
Gregory O’Brien brings this action against EverQuote, Inc. (“EverQuote” or
“Company”) for unlawful termination of his employment in retaliation for refusing EverQuote
executives’ demands to illegally disclose a competitor’s trade secrets to EverQuote, and for
reporting his manager’s egregious sexual comments in the workplace.
Mr. O’Brien was a high-performing Senior Vice President at EverQuote when the
Company’s executives repeatedly demanded that he unlawfully provide EverQuote with trade
secrets and confidential information belonging to his former employer, QuinStreet, Inc.
(“QuinStreet”), including pricing, proprietary technology, and details of its contracts and
business relationships. Mr. O’Brien consistently refused to provide such information.
Mr. O’Brien also reported inappropriate sexual comments made by Hunter
Ingram, Executive Vice President, Business Development, regarding masturbation and Mr.
Ingram’s desire to have sex with a female Company employee.
In response to Mr. O’Brien’s opposition to executives’ misconduct, EverQuote
subjected him to escalating retaliation, including by suggesting he seek employment elsewhere
and submitting baseless negative feedback into the Company’s Human Resources system.
Mr. O’Brien reported his concerns about executives’ demands for confidential
and proprietary information, inappropriate sexual comments, and retaliation to the Company’s
Human Resources and Legal Departments, but the executives’ inappropriate behavior continued.
The Company purported to conduct an internal investigation, then claimed
without elaboration it could not substantiate Mr. O’Brien’s allegations.
On March 1, 2021, Mr. O’Brien’s counsel wrote to EverQuote’s Legal and
Human Resources officers to advise the Company of Mr. O’Brien’s legal claims against the
Company. Just 75 minutes after receiving the correspondence from Mr. O’Brien’s counsel,
EverQuote terminated Mr. O’Brien’s employment.
Since terminating his employment, EverQuote also has refused to make payments
owed to Mr. O’Brien pursuant to the Non-Competition and Non-Solicitation Agreement he
signed upon his hire.
