GATES Affiliated Companies endeavors to furnish a work environment which is free

from recognized hazards that are likely to cause serious physical harm to any workers or

employees at our facilities and jobsites, Each individual shall comply with all

Occupational Safety and Health Administration (OSHA) and GATES Affiliated

Companies safety and health standards, operational rules, regulations, and orders issued

which are applicable. Each subcontractor is responsible for the maintenance of safe work

environment and the enforcement of the site safety rules on its employees.

GATES Affiliated Companies and the Owner of this project believe that an effective

Safety Program includes a conscientious effort to provide a work environment free from

the use of substances, which can impair a person’s ability to function and perform his or

her job in a safe manner. We are requesting your company’s assistance in our efforts to

prevent and detect the use of alcohol and illegal substances by persons working on this

project.

GATES Affiliated Companies has provided each supplier and subcontractor an

abbreviated version of our Safety Program for review at the beginning of each year. Our

Safety Program Manual is available at the Corporate Office for your use upon request. If,

for some reason, you do not have a copy of the abbreviated version please notify our

Safety Director or any member of our Safety Committee for a copy. This “Exhibit D”

cover letter will be issued with each contract as a reminder of our attempt to insure a safe

workplace and to remind each supplier or subcontractor of his responsibility to GATES

Affiliated Companies and the individuals working in the workplace.

Subcontractor is financially responsible for all costs incurred by GATES Affiliated Companies necessary to replace said safety

equipment and hereby waive any notification requirements,
