Ohio Administrative Code|Rule 3770:1-7-09 | Ohio Lottery Commission Game Number Nine.

                                                

(A) Title and Term. Ohio Lottery Game Number Nine ("Game No. 9") shall be conducted at such times and for such periods as the Commission may determine.

(B) General Design.

(1) Game No. 9 will be a number-match lottery game.

(2) There will be four types of prize drawings to be called regular drawings, finalist drawings, finalist prize drawings and millionaire drawings, respectively.

(3) During each week of the game a regular drawing will be conducted at which one, two or three five-digit numbers will be selected at random from the set of all such numbers; one, two or three three-digit numbers will be selected at random from the inclusive set of such numbers from 000 through 499; and one, two or three three-digit numbers will be selected from the inclusive set of such numbers from 500 through 999. An equal number of three-digit numbers will be drawn from each of the inclusive sets 000 through 499 and 500 through 999, and, in each case, one of the numbers from the first set will be paired with one of the numbers from the second set. Holders of valid tickets bearing any of the numbers drawn shall be entitled to a prize award in accordance with this Rule.

(4) A drawing of numbers in another Commission Game may serve as the regular drawing in this game.

(C) Price of Tickets. The price of a ticket issued by the Commission in Game No. 9 shall be $.50.

(D) Structure and Size of Prize Disbursements.

(1) The ticket shall bear three three-digit numbers in an area associated with a prize of $10; one five-digit number in an area associated with a prize of $100; one five-digit number in an area associated with a prize of $500; one five-digit number in an area associated with a prize of $1,000; two three-digit numbers from the inclusive set 000 through 499 and two three-digit numbers from the inclusive set 500 through 999 in an area associated with eligibility to participate in a finalist drawing; and one three-digit number from the inclusive set 000 through 499 and one three-digit number from the inclusive set 500 through 999 in an area associated with eligibility to participate in a millionaire drawing.

(2) Based upon the numbers drawn in a regular drawing, prizes of $10, $20, $100, $500 and $1,000 shall be awarded to the holder of a valid ticket for that drawing as follows:

(a) a prize of $10 if the ticket bears either of the three-digit numbers drawn and designated to be associated with the $10 prize in the area of the ticket associated with the $10 prize;

(b) two prizes of $10, or an aggregate prize of $20, if the ticket bears both of the three-digit numbers drawn and designated to be associated with the $10 prize in the area of the ticket associated with the $10 prize;

(c) a prize of $100 if the ticket bears the five-digit number drawn and designated to be associated with the $100 prize in the area of the ticket associated with the $100 prize;

(d) a prize of $500 if the ticket bears the five-digit number drawn and designated to be associated with the $500 prize in the area of the ticket associated with the $500 prize; and

(e) a prize of $1,000 if the ticket bears the five-digit number drawn and designated to be associated with the $1,000 prize in the area of the ticket associated with the $1,000 prize.

(3) The holder of a valid ticket for a regular drawing bearing the pair of three-digit numbers drawn in that drawing and designated to be associated with eligibility for a finalist drawing in the area of that ticket associated with eligibility for a finalist drawing shall be eligible to participate in a finalist drawing.

(a) In the first finalist drawing of any cycle of Game No. 9, six of the participants shall be selected to be finalists, eligible to participate in a finalist prize drawing. If there are fewer than six participants, they will all be selected as finalists.

(b) In each succeeding finalist drawing, five of the participants shall be selected to be finalists, eligible to participate in a finalist prize drawing. If there are fewer than five participants, they will all be selected as finalists. The winner of the first prize in each finalist prize drawing shall be entitled to be a participant in the succeeding finalist prize drawing, if any.

(c) In each finalist drawing, each participant who is not selected to be a finalist shall receive a prize of $500.

(4) In each finalist prize drawing one first prize shall be awarded, which shall be in an amount not less than $20,000 nor more than $250,000; and five prizes of at least $5,000, but not more than $14,000, the total of which is at least $25,000, but not more than $70,000, shall be awarded.

(5) The holder of a valid ticket for a regular drawing bearing both of the three-digit numbers drawn in that drawing and designated to be associated with eligibility for a millionaire drawing in the area of the ticket associated with the millionaire drawings shall be eligible to receive a prize award in a millionaire drawing. In each millionaire drawing, one prize of $1,000,000 will be awarded, and additional prizes in the amounts of $100,000, $50,000, $10,000, $2,000 and $1,000 may be awarded. Each participant in a millionaire drawing shall win at least $1,000.

(E) Number of Prize Disbursements.

(1) The number of prize awards in any regular drawing will depend on the number of tickets actually sold for that drawing. Tickets shall be printed using random techniques in order that:

(a) the possible numbers specified in this Rule are randomly distributed throughout all the tickets printed in any given ticket issuance; and

(b) mathematical reasoning indicates that, over a sufficiently large number of weeks, the average number of winning tickets in the regular drawings per one million tickets sold is as follows:

(i) 5,984 tickets winning prizes of $10;

(ii) 8 tickets winning two prizes of $10;

(iii) 10 tickets winning prizes of $100;

(iv) 10 tickets winning prizes of $500;

(v) 10 tickets winning prizes of $1000;

(vi) 16 tickets winning eligibility for a finalist drawing; and

(vii) 4 tickets winning eligibility for a millionaire drawing.

(2) In the first finalist drawing of any cycle of the Game, six finalists will be selected, unless there are fewer than six participants in said finalist drawing, in which case all participants shall be selected as finalists. In each succeeding finalist drawing in that cycle, five finalists will be selected, unless there are fewer than five participants in any finalist drawing in which case all participants in said finalist drawing shall be selected as finalists. The number of prizes of $500 awarded to participants not selected as finalists will depend on the number of persons eligible for the particular finalist drawing.

(3) In each finalist prize drawing one first prize, which shall be in an amount not less than $20,000 nor more than $250,000, shall be awarded as follows: the participant who becomes entitled to play for the first prize as provided below in subparagraph (E)(4) shall, in a first prize round, select four prize amounts from a set of twenty-five prize amounts containing one prize amount of $100,000; three prize amounts of $50,000; two prize amounts of $25,000; two prize amounts of $15,000; and seventeen prize amounts of $10,000. This participant's total and sole prize in the finalist prize drawing shall be the first prize equal to the sum of the four prize amounts which he or she selects in the first prize round provided in this paragraph (E)(3).

(4) In each finalist prize drawing, five prizes of at least $5,000, but not more than $14,000, the total of which is at least $25,000, but not more than $70,000, shall be awarded as follows:

(a) All finalists in each finalist prize drawing shall participate in three prize amount selection rounds;

(b) In the first round, each of the participants shall select, serially, one of the following prize amounts: $500, $700, $900, $1,100, $1,300, $1,500;

(c) In the second round, each of the participants shall select, serially, one of the following prize amounts: $1,000, $1,500, $2,000, $2,500, $3,000, $3,500;

(d) In the third round, each of the participants shall select, serially, one of the following prize amounts: $4,000, $4,500, $5,000, $5,500, $6,000, $7,500;

(e) The participant who has selected the largest cumulative total of prize amounts shall be entitled to play for the first prize as described above in paragraph (E)(3). Each of the remaining participants shall win the sum of the prize amounts he or she selected in the three rounds.

(5) The Commission may modify the prize structure of finalist prize drawings from time to time during the conduct of Game No. 9, provided that the prize structure must comply with the requirements of this Rule and the Lottery Act.

(6) In each millionaire drawing one prize of $1,000,000 will be awarded. The Commission shall determine the exact structure of lesser prizes for the millionaire drawings. The prize structure may be modified by the Commission during the conduct of the Game, provided that the prize structure must comply with the requirements of this Rule and the Lottery Act. The director may limit the number of participants in any given millionaire drawing to 100.

(F) Frequency of Prize Drawings.

(1) A regular drawing will be held each week on a day to be determined by the Director; a finalist and a finalist prize drawing will be held in every week, on days to be determined by the Director, provided that no such drawings will be held in the first week, and no finalist prize drawing will be held in the second week, of a given cycle of the Game; and a millionaire drawing will be held as soon as is practicable after each date on which 100 eligible holders are determined.

(2) If holders of valid winning tickets who are eligible to participate in a finalist drawing or a millionaire drawing claim their prizes after the last such drawing of a given cycle of Game No. 9, but otherwise in accordance with the Lottery Act and these Rules, the Director shall adopt procedures to afford such persons the opportunity to participate either in a finalist drawing and, for the finalists there selected, the opportunity to participate in a finalist prize drawing, or the opportunity to participate in a millionaire drawing, as the case may be, under circumstances as similar as is practicable to the circumstances of such drawings held during the applicable cycle of the Game. The winner of the last finalist prize drawing held under this paragraph shall not be entitled to participate in a succeeding finalist prize drawing.

(G) Manner of Prize Drawings.

(1) Prize drawings shall be open to the public and, whenever possible, persons eligible to win prizes shall be encouraged to attend and participate. Drawings may be held at the Commission's headquarters, its regional offices or other places throughout the State as the Director determines. The Director shall inform the public as to the time and place of each prize drawing.

(2) All holders of valid tickets for a given regular weekly drawing are eligible to win in that drawing. Prize winners shall claim their prizes, or their eligibility for a finalist drawing or millionaire drawing, won in regular drawings by surrendering their tickets in accordance with the procedures of these Rules.

(3) At each finalist, finalist prize and millionaire drawing, the participant who wins a given prize shall be selected at random.

(4) All drawings in Game No. 9 will be conducted in accordance with random procedures approved by the Director. For every drawing in Game No. 9, the Director will approve procedures and mechanisms for the selection of winners and the awarding of prizes in order that, insofar as is possible, random selection will be achieved.

(H) Director's Conduct of Game No. 9.

(1) A mechanical error in printing the numbers on a ticket shall not invalidate that ticket. To the extent feasible, the Director shall establish procedures by which the holder of any ticket on which the numbers are incorrectly printed due to mechanical malfunction can be advised of the correct numbers for the ticket. If it is not technically feasible to recover the numbers from a mechanically misprinted ticket, and it is possible that the ticket was a winning ticket, the holder shall be entitled to a return of ticket price or a free ticket for the next regular drawing in the Game, if any.

(2) The Director shall conduct Game No. 9 in a manner consistent with the Lottery Act, the Rules of the Commission, including without limitation this Rule 3770:1-7-09, and the Regulations of the Director. As he deems it necessary or advisable, he shall adopt management regulations, orders or directives to implement and operate this lottery game.

(3) Names and definitions of elements of Game No. 9 used in this Rule are to be considered generic terms used solely for the purpose of this Rule. In actual operation, Game No. 9 and these elements may be given names or titles chosen by the Commission.
