Nothing in this chapter limits the right to recover for damages caused by an attachment or protective order on any common law theory of recovery.
The Court first agrees with defendant that because defendant is invoking section 490.060, and not section 490.010, defendant’s recovery can exceed the amount of the undertaking. The Court also agrees with defendant that it is unnecessary for defendant to file a separate lawsuit to recover these damages, as section 490.060 doesn’t require it and section 490.010 doesn’t prevent it. 3. That leaves the question of whether plaintiff engaged in common law abuse of process.
