However, section 4404 only applies to banking institutions and, because it is part of Division 4 of the Commercial Code, cannot be asserted as a defense to section 1719. See Civ. Code § 1719(k) ("Nothing in this section is intended to condition, curtail, or otherwise prejudice the rights, claims, remedies, and defenses under Division 3...of the Commercial Code[.]"). Moreover, the court is unable to conclude on this limited record that section 3402(c) bars the second cause of action as a matter of law.
