Biography

The Hon. Stuart M. Bernstein (Ret.) is a former judge for the United States Bankruptcy Court for the Southern District of New York. He was appointed to the bench in 1993. Bernstein retired on September 30, 2020.


During his judicial tenure, he served for ten years as Chief U.S. Bankruptcy Judge for the Southern District of New York (2000 to 2010).


Before his appointment, Bernstein worked for several years as an attorney at Kensington & Ressler, P.C., in New York.


He received a bachelor’s degree from Queens College in 1972. Bernstein then completed a J.D. at Fordham University School of Law in 1975.


He was admitted to practice in New York (1976), the United States Court of Appeals for the Second Circuit (1979), the United States Court of Appeals for the District of Columbia (1984), the United States Tax Court (1985), the United States District Court for the Southern and Eastern Districts of New York (1976).


He began his legal career as an associate at Rosenman & Colin in New York before becoming a federal prosecutor for the Southern District of New York in 1978. Then, following his tenure as an Assistant United States Attorney, Bernstein returned to private practice in 1989.


He also taught as an adjunct professor at the Benjamin N. Cardozo School of Law, Fordham University School of Law, and St. John’s University School of Law.


Bernstein served for a handful of years on the Committee for the Administration of the Bankruptcy System and the Advisory Committee for Bankruptcy Rules. His other memberships include the Association of the Bar of the City of New York and the National Conference of Bankruptcy Judges.
