Appointed By: Pres. Barack H. Obama, II
The Hon. Mark G. Mastroianni is a judge on the United States District Court for the District of Massachusetts. He was nominated to the bench by former President Barack Obama on January 6, 2014, filling a seat vacated by the Hon. Michael Adrian Ponsor. His nomination was confirmed by the United States Senate on June 4, 2014.
Mastroianni has presided over a number of notable cases. For example, in 2019, he issued a decision siding with challengers in a trademark case involving the name “fire cider.” A company had registered the phrase as a trademark in 2012, pushing challenges to contend that the phrase is a longstanding concept in herbalism that cannot be trademarked. Mastroianni ruled that “fire cider” is a generic term.
Prior to his appointment, Mastroianni was the District Attorney for Hampden County, a position to which he was named in 2011. During his tenure there, he opened an unsolved-crime unit and a DNA unit, which allowed several cold cases to be solved.
Mastroianni earned a B.A. from American International College in 1986. He then completed a J.D. at Western New England University School of Law in 1989. As a law student, he clerked at Hurley, Melikian, Sousa & McFarlin (1988 to 1989) and the Law Office of James McEwan (1989).
He is licensed to practice in Massachusetts (1990).
After graduating from law school, Mastroianni began his legal career as an assistant district attorney with the Hampden County District Attorney’s Office. He worked in that capacity until 1995, at which time he entered into private practice in Springfield. He represented clients in criminal defense matters, holding positions as a sole practitioner in his own private practice (1995 to 2011) as well as an attorney in the Law Office of Vincent Bongiorni (1995 to 2000).
He opened his own private practice as a sole practitioner, supplementing it with service as an attorney in the law Office of Vincent Bongiorni (1995 to 2000).
Born in Springfield, Massachusetts, Mastroianni attended Cathedral High School. He is a married father with three children.
