The Hon. Mark A. Montour is an associate justice for the Supreme Court of the State of New York, Appellate Division, Fourth Judicial Department. Montour was appointed to the Appellate Division by Governor Kathy Hochul on September 29, 2022.
Prior to his appointment, Montour served as a justice for the Erie County Supreme Court in the 8th Judicial District of New York, a position to which he was elected in 2013. While on the bench, he held assignments as acting administrative judge of the 8th Judicial District and as the supervising judge for Genesee and Wyoming County Town and Village Justice Courts. The 8th Judicial District includes Allegany, Cattaraugus, Chautauqua, Erie, Genesee, Niagara, Orleans, and Wyoming counties.
Montour began his judicial career as an acting judge on the Buffalo City Court (2010 to 2013). During this time, he initiated the Lancaster Problem-Solving Court, a drug diversion court in the Town of Lancaster.
Montour earned a B.A. from Canisius College in 1980. He then completed a J.D. at the University at Buffalo School of Law in 1983. He was admitted to practice in New York (1984) and Florida (1985).
After graduating from law school, Montour began his legal career as an associate at Sargent & Repka in 1983. Four years later, he left the firm and joined Amigone, Sanchez, Mattrey & Marshall, where he practiced for the next eighteen years. Then, in 2005, Montour started his own private practice as a sole practitioner. He worked in this capacity until 2013, specializing in criminal defense, real estate transactions, civil contracts, wills, trusts, and estates, and American Indian law.
Montour supplemented his practice as town justice for the Town of Lancaster (2008 to 2010) and as a council member for the Town of Lancaster (1996 to 2008).
His memberships have included the Erie County Bar Association, the New York State Bar Association, the Florida Bar Association, the Minority Bar Association of Western New York, the Erie County Magistrates Association, and the New York State Magistrates Association.
Montour has served as chairman of the New York State Tribal Courts Committee, State facilitator for New York-Federal-State and Tribal Courts and Indian Nations Justice Forum, and a member of the Advisory Committee on Judicial Ethics.
A fourth-generation Western New Yorker, he was raised in the Town of Tonawanda, the son of an autoworker. Montour is an enrolled member of the St. Regis Mohawk Indian Nation and is recognized on the Kahnawake Kanien'keha:ka Registry. He is thought to be the first Native American justice to serve in New York State's Appellate Division.
He is registered as a Democrat.
