Biography

The Hon. Erithe A. Smith (Ret.) is a recalled judge for the United States Bankruptcy Court for the Central District of California. She was appointed to the bench by the United States Court of Appeals for the Ninth Circuit on May 2, 1994. Smith was appointed a recalled judge in 2022.


She received a bachelor’s degree from Loyola Marymount University in 1979. Smith then completed a J.D. at the University of California, Berkeley School of Law, in 1982.


After graduating from law school, she began her legal career as a judicial law clerk to the Hon. Marcus M. Kaufman with the California Court of Appeal. Smith then began a clerkship with the Hon. Peter M. Elliott on the United States Bankruptcy Court in 1983. Two years later, she entered private practice as an associate at McKittrick, Jackson, DeMarco & Peckenpaugh in Newport Beach. Smith then joined Lobel, Winthrop & Broker in Irvine in 1987. She was named a partner in the firm and continued in her practice there until joining the federal bench.


Her memberships include the National Conference of Bankruptcy Judges, the Association of Business Trial Lawyers (Orange County Chapter), and the Orange County Bankruptcy Forum (past president).
