Judge David F. Everett - Professional Background & Legal Expertise

Biography

The Hon. David F. Everett is a Justice of the Westchester Supreme Court in the Ninth Judicial District of New York. He was elected to the Supreme Court bench in 2018. Previously, Justice Everett had served as a judge for the Westchester County Court after being elected to the seat in 2014. After his election to the County Court, Justice Everett was appointed to serve as an acting surrogate of the Westchester County Surrogate’s Court in 2015.

He is a registered Democrat.

He received his B.A. from Brooklyn College in 1973. He went on to earn his J.D. from Syracuse University School of Law in 1976.

Everett enlisted in the New York Army National Guard at the age of seventeen. His thirty-year military career included serving as an officer in the U.S. Army Reserve and three combat-zone deployments to the Persian Gulf War in 1991, Iraq from 2005 to 2006 and to Afghanistan in 2009. He retired from the U.S. Army Reserve with the rank of Colonel.

During his civilian legal career, Everett first worked as an assistant district attorney with the Kings County District Attorney’s Office from 1976 to 1980.

After leaving the D.A.’s office, he worked for two years as a trial attorney with the Commodity Futures Trading Commission before then returning to the public sector in 1982. At that time, he joined the Queens County District Attorney’s Office, where he would serve as chief of its Criminal Court Bureau. In 1986, Everett rejoined the Kings County D.A.’s office as its deputy chief of the Supreme Court Bureau.

In 1990, he left the public arena to enter into private practice, eventually opening his own law firm in 1995. Everett remained in that capacity until his election to the County Court bench.

He was the former chair of the Service Academy Review Board for Congresswoman Nita Lowey and has served on the executive committee of the Board of Visitors of the City University of New York School of Law, where the Law School’s moot courtroom, the Everett Family Moot Courtroom, was named in his honor.

He has also served as a trustee of the Jewish Board of Family and Children’s Services and as a faculty member of the Intensive Trial Advocacy Program at Yeshiva University, Benjamin N. Cardozo School of Law.
