COMES NOW, Defendant CLARDY A. MALUGEN (“Malugen”), by and through its
undersigned counsel, and files its objection to HODGES BROTHERS, INC.’s (“Hodges
Brothers”) Notice of Production from Non-Party for the following Non-Parties (“Notice of
Production”):

and states that the records requested through the Subpoena Duces Tecum Without Deposition is
improper as to date, Kancor Companies is an undisclosed / non-designated potential expert for
Malugen and is only known to Hodges Brothers as a consequence of the mediation process in this
