COMES NOW Defendant, CITIZENS PROPERTY INSURANCE CORPORATION, by
and through its undersigned counsel, and pursuant to Fla. R. Civ. P. 1.140(h) hereby files this, its
Motion to Dismiss for Failure to Join an Indispensable Party, and as grounds therefore would
state as follows:

1. This Complaint alleges breach of contract for alleged, due and owing, homeowner
insurance proceeds for damage at Plaintiff's home.

2. This action is being brought pursuant to a homeowner insurance policy which was
issued by Defendant to Elizabeth Duarte for property address 128 SE oui Ave., Boynton Beach
