FOR ORDER TO SHOW CAUSE DIRECTED CVS PHARMACY

COMES NOW, the Defendant, CHLN, INC. d/b/a CHART HOUSE
RESTAURANT, by and through its undersigned counsel, and hereby moves this
Honorable Court to grant this Motion for Order to Show Cause Directed to CVS
Pharmacy, and as grounds in support therefore states as follows:

1. This suit arises out of an incident which occurred on December 8,
2009.

2. Subsequently, the Plaintiff, SANDRA WELLS, filed a Complaint
and Demand for Jury Trial against Defendant, CHLN, INC. d/b/a CHART

HOUSE RESTAURANT.

3. Defendant sent a Subpoena Duces Tecum to CVS Pharmacy for
Sandra Wells’ medical records, and the same was served on this provider on or
