AFFIDAVIT OF COMPLIANCE WITH RULE 9A

Now comes Charles D. Rotondi, Attorney for the Defendants Susan B. Amato and Rosemary
Hinton and states the following under the penalties and pains of perjury:

11 aman attorney licensed to practice law in the Commonwealth of Massachusetts, BBO
#431260.

2. On May I, 2019, | mailed via first class mail copies of the enclosed Motion to Bifurcate Trial
regarding the above captioned case to all attorneys of record,(See copy of Certificate of Service
enclosed).

3. In my cover letter to all three attorneys dated May 1, 2019 | noted the following: “In
accordance with Rule 9A, you have 13 days to respond.”

4.1 did not receive any response from any attorney within the 13 day period.

5. On May 29, 2019 | spoke with Attorney Kenney Mazonson and he informed me that he had
no objection …
