Defendant

Now comes the Plaintiff, Francis J. Duda, M.D., (“Duda”) and hereby moves that
this Honorable Court award the additional attorney's fees incurred in opposing the post
trial motions of the Defendant, Baystate Medical Practices, Inc., f/k/a Baystate Medical
Education and Research Foundation, Inc., (“BMP”).

Following a jury verdict in favor of Dr. Duda on his claim for discrimination based
on handicap, BMP filed Motions for Judgment Notwithstanding the Verdict, For a New
Trial, and for Remittitur (“Motions”). Dr. Duda opposed the Motions. Following a
hearing the Court (Callan, J.) denied the Motions.
