DEFENSES TO COUNT I OF PLAINTIFF'S COMPLAINT

OMEGA INSURANCE COMPANY (hereinafter “OMEGA”), pursuant to Florida Rule of
Civil Procedure 1.140, hereby files its Answer and Affirmative Defenses to Count I of Plaintiff's
Complaint, and states:

1. The allegations contained in Paragraph 1 are not directed to OMEGA and are
jurisdictional in nature, and thus no response is required. To the extent a response is deemed to be
required, OMEGA admits only that Plaintiffs have alleged damages in excess of $30,000.00 within
the jurisdictional amount required in this Court, but denies Plaintiffs are entitled to any relief.
