INTRODUCTION

This Court has already correctly observed, at the September 15, 2010 hearing in this
matter, that plaintiff's latest proposed class motion is just a recycled version of his prior,
unsuccessful class certification attempt. Nonetheless, the Court gave plaintiff the opportunity to
submit a brief explaining why he should be permitted to proceed with his new class certification
motion. Plaintiff ignored the Court’s ruling and never submitted any such brief. Instead, on the
