Defendant, ALLSTATE PROPERTY AND CASUALTY INSURANCE COMPANY, by

and through the undersigned counsel, moves this Court for entry of a Final Judgment dismissing
this action for failure to comply with a court order and states:

1. On January 9", 2014 this Court granted Defendant’s Motion to Compel Appraisal.
(A copy of the order is attached as Exhibit A)

2. The Plaintiff was ordered to retain a certified appraiser within 30 days.

3. It has now been well over two months and the Plaintiff has not complied with the
Court’s order.
