This cause came before the Court on July 15, 2009 on Plaintiff, Teresa M. Cortinas, M.D.,

P.A. and Third-Party Defendants, Walter E. Wojcicki, M.D., Ph.D., P.A., (“Physicians”) Motion to
Compel Production of Documents Re: Subpoena Duces Tecum to Midtown Imaging (the “Motion”),
and it is Ordered as follows:

1. As to Request #1, Defendants have agreed that Diagnostic Ancillary Services, LLC
(“Diagnostic”) will be liable for any judgment obtained against Advanced Imaging Associates, LLC
