BELLA CASA, LLC’S MOTION FOR SUMMARY FINAL JUDGMENT

DEFENDANT, BELLA CASA, LLC (hereinafter “BELLA CASA”), through
undersigned counsel, and pursuant to Fla. R. Civ. P. 1.510, files this its Motion for Summary
Final Judgment as to the Cross Complaint filed against it by ROSS INDUSTRIES, LLC and
ROBERT L. ROSS (hereinafter “ROSS”), and states:

1. This is an action by Plaintiff, FLORIDA ATI, INC. d/b/a ADVANTAGE
TRANSPORTATION (hereinafter “ATI”), for breach of contract against Defendant ROSS
INDUSTRIES, LLC and ROBERT L. ROSS (hereinafter collectively referred to as “ROSS”),
and for foreclosure of a mechanics lien against BELLA CASA, LLC.
