     MOTION FOR ORDER OF COMPLIANCE OR NONSUIT FOR FAILURE TO
      RESPOND TO WRITTEN DISCOVERY REQUESTS PER COURT ORDER

       The Defendants hereby move the Court to enter an order of compliance or non-suit against

the plaintiff for failure to answer wrongful death interrogatories and requests for production by

December 14, 2023 pursuant to the Honorable Shaban, J.’s order requiring the same. (See Docket

Entry No. 108.01).

       The defendants are highly prejudiced by the plaintiff’s failure to respond to needed

discovery given the current trial date of August 6, 2024.
