                         PLAINTIFF'S MOTION FOR DEFAULT J UDGMENT

         Texas Dow Employees Credit Union ("TDECU" or "Plaintiff’) files this Motion for

Default J udgment (the "Motion"), pursuant to Texas Rules of Civil Procedure 239 and

241,   seeking judgment for liquidated damages                  against    Defendant         Henry     King     (the

"Defendant").         TDECU appeared in person and by its attomey of record and announced

ready for trial.         The   Defendant,    having   been    duly and     legally cited to appear and

answer, has failed to appear and answer, and has wholly made default.
