RECOMMENDED ORDER OF MAGISTRATE

This cause came on for hearing before Magistrate Deborah A. Bailey, on August
10, 2009, on the Motion to Vacate Default, filed by Defendant, Andrew Corridori
(hereinafter “Corridori”). The Magistrate has jurisdiction pursuant to Rule 1.490 of the
Florida Rules of Civil Procedure. Being fully advised in the premises, the Magistrate

reports as follows:

1. Onor about July 3, 2007, Plaintiff filed its Complaint to Foreclose Mortgage.
After several unsuccessful attempts at personal service, Plaintiff filed an Affidavit of
Constructive Service on or about November 24, 2008. On December 4, 2008, the Clerk
issued a Certificate of Mailing, indicating that a copy of the Notice of Action and
Complaint had been mailed to Corridori at a residence address in …
