Comes now, the undersigned party and attorney and moves pursuant to Florida Rules of
Judicial Administration 2.3330, and requests this court to disqualify Judge James Martz in this
matter for the reasons stated as follows:

1. This is a wrongful death negligence action. On July 28, 2020, Judge Martz phoned the
undersigned attorney to express displeasure in the handling of his wife's case being
prosecuted by another attorney at Rosenthal, Levy, Simon & Sosa. Judge Martz informed
