What Is a Motion to Strike?
Background
“As a general rule, a motion to strike an affirmative defense is not favored by the courts.” (See N.K.S. Distribs., Inc. v. Wheeler, Wolfenden & Dwares, P.A., C.A. No. N11C-11-146-JRJ, at *8 (Del. Super. Ct. Sep. 26, 2014).)
“Therefore, such a motion is granted only where the facts viewed most favorably to the defendant cannot, as a matter of law, support the affirmative defense.” (See N.K.S. Distribs., Inc. v. Wheeler, Wolfenden & Dwares, P.A., C.A. No. N11C-11-146-JRJ, at *8 (Del. Super. Ct. Sep. 26, 2014).)
“Motions to strike are not favored and are granted sparingly, and then only if clearly warranted, with doubt being resolved in favor of the pleading.” (See Stinnes Interoil, Inc. v. Petrokey Corp., Diamond Industries, Inc., 1983 WL 412258, *1 (Del. Super. 1983); McCormick v. Hoddinott (2004) 865 A.2d 523, 525; N.K.S. Distribs., Inc. v. Wheeler, Wolfenden & Dwares, P.A., C.A. No. N11C-11-146-JRJ, at *9 n.27 (Del. Super. Ct. Sep. 26, 2014).)
General Information for Complaints and Motions
“Upon motion made by a party before responding to a pleading or, if no responsive pleading is permitted by these rules, upon motion made by a party within 20 days after the service of the pleading upon him or upon the court's own initiative at any time, the court may order stricken from any pleading any insufficient defense or any redundant, immaterial, impertinent, or scandalous matter.” (See Fowler v. Mumford (1954) 48 Del. 282, 284 n.1.)
“Motions to strike are not favored for the determination of disputed and substantial questions of law. Such motions should be limited in scope and operation and may be denied where there is no showing of prejudice to the moving party if the attacked allegations are left in the pleadings.” (See id.)
“A party that seeks to strike an averment in a complaint must show that the averment is not relevant to an issue in the case, or that it is ‘unduly prejudicial.’” (See Bear Stearns Mortg. Funding Trust 2007-AR2 v. EMC Mortg. LLC, C.A. No. 6861-CS, at *3 (Del. Ch. Jan. 15, 2013).)
“Ordinarily, in passing upon motions to strike, courts decline to determine disputed and substantial questions of law or the legal consequences of pleading.” (See Fowler v. Mumford (1954) 48 Del. 282, 287.)
“If an answer fairly presents, as a bona fide defense, a substantial question of law which should be heard and determined on the merits, the defense is not ‘insufficient’ under Civil Rule 12(f) and should not be stricken.” (See id.)
Standard of Review and Burdens of Proof
“The rules of the Superior Court and other trial courts give trial judges the discretion to strike scandalous allegations that bear no relevance to the claim being asserted and are made solely to put improper pressure on the defendant.” (See Blue Hen Mech., Inc. v. Christian Bros. Risk Pooling Trust (2015) 117 A.3d 549, 558.)
“In considering a motion to strike an affirmative defense, the Court must determine whether the affirmative defense presents a bona fide issue of fact or law.” (See N.K.S. Distribs., Inc. v. Wheeler, Wolfenden & Dwares, P.A., C.A. No. N11C-11-146-JRJ, at *8 (Del. Super. Ct. Sep. 26, 2014).)
“In granting such a motion, the trial court retains the discretion to shift fees and impose sanctions for the improper conduct.” (See Blue Hen Mech., Inc. v. Christian Bros. Risk Pooling Trust (2015) 117 A.3d 549, 558.)
“There is general judicial agreement that a motion to strike will be denied unless the challenged allegations have no possible relation to the subject matter of the case.” (See Bear Stearns Mortg. Funding Trust 2007-AR2 v. EMC Mortg. LLC, C.A. No. 6861-CS, at *3-4 (Del. Ch. Jan. 15, 2013).)
“A Motion to Strike, however, will be granted where a plea upon its face appears to be frivolous, dilatory, vexatious or nugatory. This Court notes that granting a Motion to Strike is permissive, not mandatory, and therefore a Court must exercise its own judgment.” (See Belfint v. Potts Welding Boiler Repair, C.A. No. 01C-04-046-CLS, at *1 (Del. Super. Ct. Oct. 17, 2005).)
The Court’s Decisions
It is well settled that “a motion to strike under Superior Court Rules, Civil rule 12(f), Del. C., is not proper where it seeks the dismissal of one of the causes of action in a complaint as a matter of law.” (See Johnson v. Hamilton (1962) 55 Del. 133, 136-37.)
It is also well settled that “[t]he Court must consider whether the pleaded matter has some relevancy to the cause of action, is directly in reply to the matter which is pleaded and is offered in support of a direct issue. Thus, a plea which does not set out any issuable fact . . . will be ordered stricken out.” (See Pack Process, Inc. v. Celotex, Corp. (1985) Del. Super., 503 A.2d 646, 660; Crowhorn v. Nationwide Mutual Ins., C.A. No. 00C-06-010 WLW, at *1 n.31 (Del. Super. Ct. Apr. 26, 2001).)
