“The doctrine of lis pendens originated at common law, but is now controlled in many States — including Illinois — by statute.” (E & E Hauling, Inc. v. County of Du Page (1979) 77 Ill. App. 3d 1017, 1024.)
“‘Lis pendens’ means a pending suit. Under the lis pendens doctrine anyone who purchased or otherwise acquired an interest in property involved in litigation took such interest subject to the outcome of the litigation.” (Bighorn Capital, Inc. v. 1000 SMA, LLC., No. 05 C 5364, at *4-5 [N.D. Ill. Nov. 9, 2005] citing United States v. First Midwest Bank/Illinois, N.A., No. 97 C 7365, 1997 WL 675192, at * 19 [N.D. Ill. Oct. 28, 1997].)
“State law governs the creation and cancellation of lis pendens in both federal and state courts.” (Bighorn Capital, Inc. v. 1000 SMA, LLC., No. 05 C 5364, at *5 n.2 [N.D. Ill. Nov. 9, 2005] citing Duncan v. Farm Credit Bank of St. Louis (1991) 940 F.2d 1099, 1101 [7th Cir.][additional citations omitted].)
“Under Illinois law, a party to a lawsuit may file a lis pendens notice in ‘every condemnation proceeding, proceeding to sell real estate of decedent to pay debts, or other action seeking equitable relief, affecting or involving real estate.” (Bighorn Capital, Inc. v. 1000 SMA, LLC., No. 05 C 5364, at *5 [N.D. Ill. Nov. 9, 2005] quoting 735 ILCS 5/2-1901.)
“The effect of a properly filed lis pendens notice is to give ‘constructive notice to every person subsequently acquiring an interest in or lien on the property affected thereby, and every such person acquiring an interest or lien ... not in possession of the property and whose interest or lien is not shown of record at the time of filing such notice, shall, ... be deemed a subsequent purchaser and shall be bound by the proceedings to the same extent and in the same manner as if he or she were a party thereof.’” (Id.)
“For the doctrine to be applicable, three requirements must be satisfied:
(First Midwest, A Div. of Jacksonville Sav. Bank v. Pogge (1997) 687 N.E.2d 1195, 1198 [internal citiations omitted].)
“The doctrine of ‘lis pendens may apply to any proceeding.... It is the existence of the suit itself, not the prohabilities of success, which invokes the principle of lis pendens.’” (Id. at 1999; Bighorn Capital, Inc. v. 1000 SMA, LLC., No. 05 C 5364, at *6 [N.D. Ill. Nov. 9, 2005].)
“As with an order quashing a discovery subpoena, an order quashing a lis pendens is simply an administrative order that deals with how the case proceeds before the court, and it can be issued by any court without resorting to its equitable powers.”
“It then follows that, similarly to a discovery order, an order quashing a lis pendens is not an interlocutory order that is appealable under Rule 307(a)(1).” (Five Mile Capital Westin N. Shore SPE, LLC v. Berkadia Commercial Mortg., LLC (2012) 983 N.E.2d 95, 100 [holding that “[the Court of Appeals] accordingly lack[s] jurisdiction over that portion of the circuit court's order.”)
“One purpose of lis pendens is the avoidance of endless litigation of property rights precipitated by transfers of interest. This end is achieved by conclusively binding one who obtains an interest in the property during the pendency of a suit affecting it to the result of that litigation as if he had been a party from the outset. In this respect the filing of lis pendens notice is designed to protect a plaintiff from third persons who might acquire, during the pendency of litigation, interest in the subject matter of the litigation such as would preclude the court from granting the plaintiff the requested relief.” (Admiral Builders Corp. v. Robert Hall Village (1981) 101 Ill. App. 3d 132, 136-37 citing 51 Am.Jur.2d Lis Pendens § 1 (1970); E. E. Hauling, Inc. v. County of Du Page (1979) 77 Ill. App.3d 1017, 1023.)
“A lis pendens is not an injunction as it does not formally restrain sale, conveyance or purchase.” (Bighorn Capital, Inc. v. 1000 SMA, LLC., No. 05 C 5364, at *4-5 [N.D. Ill. Nov. 9, 2005] citing Id., citing EE Hauling, Inc., supra, 396 N.E.2d at 1266.)
