A “plea of privilege” is an obsolete method of challenging venue in Texas. The plea of privilege was eliminated in the 1983 revisions of the venue statutes. A motion to transfer is the proper procedural method to object to improper venues. For more up to date information on changing venues, see Motion to Transfer Venue under Texas motion summaries. A defendant no longer has the privilege to be sued in the county of the defendant’s residence or domicile. (Tex. R. Civ. P. 86, 87; Tex. Civ. Prac. & Rem. Code § 15.063)
Historically, however, the Plea of Privilege was a plea that raised an objection to the venue of an action. If a plea of privilege was filed, and the allegations of facts contained in the plea were sufficient to make a prima facie case for the removal of the cause to the county of the defendant’s residence, then the court must accept the fact as alleged in defendants plea and enter a judgment for removal.
When a plea of privilege was sustained, the court must order the venue to be changed to the proper court of the county having jurisdiction of the parties and the cause. The clerk must make up a transcript of all the orders made in the cause and send it with the original papers to the clerk of the new venue. The filing of a plea of privilege is an appearance in a case for all purposes.
Additionally, the plea of privilege "to be sued in the County of one's residence" was fully satisfied, as to "a transient person," when the cause is transferred to the place where he was "found" and where he was actually served in person with the citation.
