Before applying for a motion to unseal court records, the court must make a determination whether the documents are “court records.” (General Tire, Inc. v. Kepple, 970 S.W.2d 520, 524–525 (Tex. 1998).) The rule identifies three categories of “court records”: (1) filed documents; (2) certain settlement agreements; and (3) specified types of discovery. (Id.) All documents filed with the court are “court records” except (1) documents filed in camera to obtain discovery rulings, (2) documents to which access is otherwise restricted by laws, and (3) documents filed in actions originally arising under the Family Code. (Id.) Filed settlement agreements are “court records.” (Tex. R. Civ. P. 76a(2)(b).) Unfiled settlement agreements also qualify as “court records” if they “seek to restrict disclosure of information concerning matters that have a probable adverse effect upon the general public health or safety, or the administration of public office, or the operation of government.” (Id.)
An order on a motion to unseal court records must be in writing and should be a separate document not included in any other judgment or order. (Tex. R. Civ. P. 76a(6).) Failure to comply with the requirement that the order be a separate document, however, does not affect appealability. (Id.)
The court may determine the motion to unseal in accordance with the procedures of Rule 120a, governing special appearances. (Tex. R. Civ. P 120(a).) This rule allows the court to consider (1) the pleadings, (2) any stipulations, (3) affidavits served at least seven days before the hearing, (4) results of discovery processes, and (5) oral testimony. (Id.)
