Petitioner failed to file proof of service as required. (Cal. Rules of Ct., rule 5.94(b).) Respondent filed a Responsive Declaration and alleges that she received the motion without all the supporting declarations on January 17, 2023 by regular mail. This is invalid service and insufficient notice. (Code Civ. Proc., § 1005(b); Cal. Rules of Ct., rule 5.92.) This ruling does not prohibit Petitioner from pursuing reimbursement as requested by filing a new motion and having it properly filed and served.
