Tentative Ruling: To grant petitioner Pavitar Sond’s petition for release from property lien.
Petitioner Pavitar Sond is the owner of a car wash located at 2016/2020 N. Dinuba Blvd., Visalia, California. On or before April 11, 2018, respondent Gabriel Reynoso (a licensed contractor) did work and improvements at the petitioner’s car wash valued at $42,000.00. On April 11, 2018, Mr. Reynoso recorded a mechanic’s lien against the petitioner’s car wash for the work he had done at the petitioner’s property but had not been paid.
On or about May 15, 2018, Mr. Sond served a formal demand on Mr. Reynoso that he release the mechanic’s lien against his car wash because petitioner paid Francine Reynoso for the work and improvements that Mr. Reynoso made to Mr. Sond’s car wash. Mr. Reynoso rejected Mr. Sond’s demand to release his mechanic’s lien because “he had not been paid” for the work he did at Mr. Sond’s car wash.
