TENTATIVE ORDER
Plaintiff NOAH’S ARK PROCESSORS, LLC’s motion for enforcement of settlement and for entry of judgment is GRANTED. C.C.P. § 664.6.
Plaintiff brought this action under an open book account, seeking recovery on unpaid invoices. On September 1, 2016, plaintiff filed a Stipulation, which sets forth the terms of the parties’ settlement and is signed by all necessary parties.
The settlement required defendant to make four monthly payments, beginning on September 1, 2016, and totaling $180,000. Defendant made the first payment, but failed to make the payment due on October 1, 2016, which prompted this motion. Decl. of Ami Meyers.
The settlement provides for the Court’s retaining jurisdiction under section 664.6. It also provides that, in the event of a default, plaintiff is entitled to a judgment for the unpaid amount, interest, costs and attorney’s fees.
