I. Introduction
In this unlawful detainer action, Plaintiff Triple Green Property, LLC (landlord) alleges that three different defendants (its tenants) have failed to pay rent under a 2006 written lease agreement. (Complaint, ¶ 6.) Triple Green seeks to recover possession of the premises and damages. (Id., ¶ 17.)
Triple Green allegedly executed a lease agreement with defendant Braun Development Group, Inc. in 2006. (Id., Exh. 1.) A sublease agreement was purportedly executed between Braun and defendant Golf Apparel Brands, Inc. in 2015. (Id.) This sublease agreement was not signed by Golf, however. It was only signed by Triple Green as the “Lessor” and Braun as the “Lessee.”
Defendant Golf demurs to the Complaint. There was no opposition filed, but Golf’s Reply notes that an opposition was served four days late. Triple Green’s failure
