Los Angeles County, California. Hearing Date 12.14.2017.
Matter on calendar for: Hearing on unopposed motion to be relieved as counsel
Tentative ruling:
I. Background
In this quiet title-based action, Plaintiff Juan Perez’ counsel, David L. Speckman, Esq., moves to be relieved from further representing Plaintiff. Speckman filed moving and supporting papers on all interested parties on November 20, 2017, and served all interested parties on November 15, 2017.
Speckman moves to be relieved as counsel due to a conflict of interest due to a “breakdown in attorney client relationship which makes it near impossible for Attorney to continue to adequately represent Client. Client is not responding to Attorney’s communications, not responding to discovery, and has become hostile toward Attorney.” (Speckman Decl.)
A Final Status Conference is scheduled for January 22, 2018, and jury trial is set for January 28, 2018.
