I. Background

Plaintiff James Yun was a truck driver for defendants KLF Logistics, Inc., and KL Fenix Corp., from 2013 to 2015 and argues he was an employee, not an independent contractor under common law, IWC wage orders, and the California Labor Code. After trial, the jury returned a verdict finding that plaintiff was an employee, and that KLF Logistics, Inc., failed to provide Yun with accurate wage statements. The jury assessed a $4,000 penalty. The jury found for defendants on all other special verdict questions. The eighth cause of action for violations of the Business and Professions Code § 17200 was submitted to the Court with closing briefs from the parties. The Court found for defendants.
