Defendant Valley Mountain Regional Center Inc, (VMRC) moves to strike portions of the complaint of Plaintiff Brittany Gonzales, an individual, and as successor in interest of decedent Jaxson Terrell Love. Having read and considered the written motion, opposition, and reply, the court issues the following tentative ruling:
Defendants move to strike references to punitive damages, civil and statutory damages, treble damages, restitution in equity, attorney fees, and injunctive relief.
The complaint alleges only the Second cause of action for Negligence against the Therapist-Defendants.
Defendant VMRC is included in the definition of Therapist-Defendants as used in the complaint on file.
It is alleged in paragraph 24(a) of the complaint that decedent was referred to the early start program, administered through Therapist-Defendants and that the Therapist-Defendants routinely visited decedent twice per week observing decedent’s behavior and inj
