Defendants Jeffery and Jeanette Gatlin move to dismiss the action filed by Plaintiffs Jamali Robinson and Marni Gatlin. Having read and considered the written motion and opposition, the court issues the following tentative ruling:
Defendants contend that the case should be dismissed because Plaintiffs filed a fraudulent proof of service and incomplete complaint. Jeanette Gatlin has appeared when she filed her motion to set aside the default and her answer. Jeffery Gatlin has appeared by filing his answer.
The motion to dismiss is denied.
Defendants Jeffery and Jeanette Gatlin have filed a notice of stay pursuant their filing of bankruptcy. All pending motions against Defendants Jeffery and Jeanette Gatlin are stayed.
The case management conference scheduled for October 21, 2019 at 8:30 a.m. in Department 11B will remain.
