Defendants Frank and Cynthia Alfaro move to compel Plaintiff Paul Vogt to provide further responses to a Request for Production of Documents (Set One) No.16, or in the alternative issue sanctions, and for monetary sanctions of $4,340.00. Having read and considered the written motion, opposition, the court issues the following tentative ruling:
Defendants served discovery requests to provide further responses to a Request for Production of Documents. Defendant requested in No. 16 “Any and all documents that reflect your total monthly income at the time of the incident.” Plaintiff produced three Profit and Loss statements. Defendants seek “actual business-related documents” to support Plaintiff’s claim of his wage loss of $430,000.00. Defendants seek copies of checks and proofs of purchase to corroborate the items listed on the P&L report.
Counsel have met and conferred but disagree whether Plaintiff has adequately complied with the request.
