MOTION: Defendant’s Motion to Compel Production of Documents and Additional Days of Deposition

TENTATIVE RULING

This is a case alleging on-the-job discrimination and harassment on the basis of race. After an informal discovery conference, the court agreed to limit plaintiff’s deposition to two days. Defendant served deposition notices on plaintiff Edogun in June 2019. The deposition took place on July 9 and 10, 2019. Defendant moves to compel plaintiff to reappear for additional days of deposition and to produce documents requested in the deposition notice.

A court may order further deposition time “if needed to fairly examine the deponent or if the deponent, another person, or any other circumstance impedes or delays the examination.” Cal. Code of Civ. Proc. §2025.290(a).

Defendant moves to compel plaintiff to reappear for further questioning. However, it failed to e
