Defendants’ Motion to Reopen Discovery and Compel the Deposition of
Plaintiff’s Person Most Qualified (PMQ)
Defendants’ motion to reopen discovery for the limited purposes of
compelling the deposition of plaintiff’s person most qualified is granted under Code of Civil Procedure section 2024.050. The court has carefully
considered the papers filed and determines defendants have made a sufficient showing that plaintiff’s discovery responses to its successful motion to compel document production from November 2018 resulted in the disclosure of new documentary evidence necessitating defendants to compel the further deposition of plaintiff’s PMQ.
The court declines to award sanctions to either party as both parties were substantially justified in their positions considering the court’s previous order made so close in time to the prior trial date.
