The Court grants the motion for prejudgment possession per CCP §1255.410(d)(1). FACTUAL / PROCEDURAL CONTEXT This is an eminent domain action brought by plaintiff City of Banning in connection with a project to widen Ramsey Street in Banning. The City actually seeks to acquire two different property interests. First, the City seeks to permanently take a 2,316 square foot portion of the subject property in order to widen the street and install a new water line; second, the City seeks to temporarily acquire an 1,828 square foot construction easement for a period of nine months while the construction takes place. The subject property is an unimproved parcel currently zoned Business Park. The City has deposited $10,600 as probable compensation--$10,000 for the permanent taking and $600 for the easement—and now asks for an order of prejudgment possession. The property owners are alleged to be Raymond and Lucy Huynh, trustees of the Raymond and Lucy Huynh Revocable Trust Dated August 8, 2007
