This action arises out of Plaintiff Levi Miller’s employment with Defendant Desert Community College District (District) and claims based upon the District’s (1) failure to properly compensate him as a full-time instructor at COD, and (2) retaliatory decision to not hire him as an Administration of Justice instructor because the California Teachers Association had attempted to resolve his claims with the District. Essentially, Plaintiff alleges that he was teaching 9 units as a part-time Administration of Justice (AJ) instructor and 10 units as Basic Peace Officer Training (BPOT) Coordinator. The BPOT Coordinator, was well over the 10 units that would require the District to classify him as full-time and that he was thereafter passed over for a position as a full-time AJ instructor after attempting to be properly classified as full-time.
