Plaintiff’s Motion for Judgment on the Pleadings.
On October 16, 2019 plaintiff filed an action related to a credit card account for common counts of open book account and for goods, wares, and merchandise sold and delivered and for which defendant promised to pay $8,269.80. Plaintiff alleges: that defendant owes a principal balance in the amount of $8,269.80; that the amount remains due and unpaid despite plaintiff’s demand; and that the last payment was received on March 28, 2019. Defendant answered the complaint by Judicial Council Form (Form PLD-C-010.) The form answer admits all of the allegations of the complaint, except paragraph 10.a, which defendant asserts is false. Paragraph 10.a. prays for damages in the amount of $8,269.80. Defendant did not assert any affirmative defenses to the action.
