Hearing Re: Default Judgment.
On September 5, 2019 the plaintiff filed a complaint for declaratory relief and partition by sale against defendant Armstrong alleging that plaintiff owns 45% of certain real property and defendant owns the remaining 55% pursuant to an agreement; defendant Armstrong also agreed to pay all maintenance and taxes on the property; and defendant has failed to pay the real estate taxes, leaving a delinquent amount approaching $20,000. The complaint did not seek an award of damages and merely sought a declaration that plaintiff owned 45% of the property and a judgment partitioning the real property by sale with 45% of the proceeds from the sale to be determined to belong to plaintiff. Default was entered against defendant on February 3, 2020.
