Plaintiffs filed an action against defendant El Dorado Irrigation District (EID) for dangerous condition of public property and against defendant Reddin for fraud by concealment when he allegedly constructed the home located on plaintiff’s property, filled a drainage gully with stumps, timbers, loose logs, brush, used building materials, loose uncompacted dirt and other materials and then covered the area with dirt to give the appearance of level, solid land, which passed through several owners without problem, until the improperly filled drainage washed out and caused a massive landslide on plaintiff’s property. Plaintiff alleged that they were damaged by the fraud in an amount in excess of $100,000.
The proof of service in the court’s file declares that the summons and complaint were personally served on defendant Reddin on February 14, 2018. Default was entered against defendant Reddin on March 27, 2018.
