Plaintiff argues: plaintiff has been effectively abandoned by initial counsel, the Cable Gallagher firm; plaintiff has retained a new law firm to represent him in this action; and plaintiff’s new counsel has been unable to make contact with Mr. Gallagher and unable to obtain his signature on a substitution of attorney form.
The proofs of service in the court’s file declare that on February 8, 2019 notice of the hearing and the moving papers were served by mail to Mr. Gallagher’s address of record with the State Bar and by mail to defense counsel. There is no opposition to the motion in the court’s file.
