Motion Re: Proposed Notice of Pendency of Class Action.
On July 5, 2019 the court entered its ruling on the motion for class certification. On July 19, 2019 defendant Serrano El Dorado Owner’s Association (HOA) filed a statement regarding class notice and submitted a proposed class notice.
Defendant HOA contends: that class members are entitled to notice and an opportunity to opt-out of the class action; the class notice should be mailed to the reasonably identified class members and published on both the HOA’s website and a standalone website at the url www.serranohoalitigation.com; defendant HOA only has names and addresses for owners in the HOA for the year of 2019; the content of the HOA’s proposed notice is proper; notice and opting-out by email is appropriate; and a combination of basic mail and electronic notice is preferable.
On July 25, 2019 plaintiff filed an objection to the HOA’s proposed class notice as non- compliant with the statutes and case law governing class notice.
