* TENTATIVE RULING: *

On March 4, 2020 Defendant Johnson filed a petition to vacate a default judgment entered against her on November 21, 2006. The file shows that substitute service of the complaint occurred on August 30, 2006. The person being served was identified as “James Doe” an occupant of the premises at 5535 Scoville Street, Oakland, Ca. This was the same address apparently used by Patricia Johnson to finance the purchase a Honda automobile. The alleged default on the financing agreement led to the Plaintiff’s filing of a complaint seeking damages arising from defendant’s default on the payments.

A clerk’s default was entered on October 26, 2006. After a default prove-up, the court entered a final default judgment on November 21, 2006. Plaintiff filed a notice for renewal of judgment on December 17, 2015 and served it by mail on December 21, 2015 at the same address used for Defendant
