The Court bases the Order After Hearing on this date upon the following Statement of Decision:

1. The present case arises out of the alleged series of abusive sexual acts committed against Plaintiff Jane Dn Doe (“Plaintiff”), a minor, by Defendant Marcus Williams (“Williams”) employee and agent of Defendant Antelope Valley Union High School District (“AVUHSD”).

2. Plaintiff filed the initial Complaint on July 12, 2018 alleging ten (10) causes of action: (1) Negligence; (2) Negligent Supervision; (3) Negligent Hiring/Retention; (4) Intentional Infliction of Emotional Distress (IIED); (5) Assault; (6) Sexual Battery (Civil Code (“Civ. Code”) section (“§”) 1708.5); (7) Sexual Harassment (Civ. Code § 51.9); (8) Gender Violence (Civ. Code § 52.4); (9) Breach of Fiduciary Duty; and (10) Constructive Fraud (Civ. Code § 1573).

3. In the Complaint, Plaintiff alleges that Williams, an adult teacher, coach, and employee of both AVUHSD and Palmdale H........
